Conditions générales de la garantie Devialet Care Phantom (à compter de Avril 2023)

La garantie Devialet Care (la « Garantie ») est soumis aux conditions suivantes (les «Conditions ») qui régissent les relations entre vous (le « Client ») et Devialet (« Devialet », « nous », « notre » ou « nos »). Sous réserve des présentes conditions générales, la Garantie couvre : 


  1. La Garantie pour Phantom I: 108dB Classic, Silver, Black, Gold, Gold Phantom Opéra de Paris | Devialet 


  1. La Garantie pour Phatom I: 103dB Classic, Silver, Black, Gold, Gold Phantom Opéra de Paris | Devialet 


  1. La Garantie pour Phantom II: 98dB White, Black, Gold Phantom Opéra de Paris | Devialet 


  1. La Garantie pour Phantom II: 95dB White, Black, Gold Phantom Opéra de Paris | Devialet 


Ci-après désignés, collectivement, par le « Produit ». 


La Garantie ne couvre que le Produit pour lequel elle est enregistrée. Par conséquent, si le Client achète plusieurs Produits, l’achat d’une Garantie distincte sera nécessaire pour chaque Produit acheté.

La Garantie permettra au Client de bénéficier du service client et d’accéder à des services en ligne liés au Produit. L’utilisation de la Garantie est soumise à l’enregistrement de votre numéro d’adhésion unique. L’enregistrement est obligatoire pour qu’un client puisse bénéficier de la Garantie. Cet enregistrement doit être fait dans les trente (30) jours suivant la date de livraison du Produit. Une Garantie ne peut pas être achetée ou impliquée à un Produit dont la livraison remonte à plus de 30 jours. 

La durée de la Garantie est de soixante (60) mois à compter de la date de livraison du Produit. Le prix de la Garantie est celui qui figure sur l’original de la facture de la Garantie. 


  • Cadre de la Garantie 

Cadre général


La Garantie s’activera lors de l’enregistrement du numéro d’adhésion unique de la Garantie. Dans le cadre du processus d’enregistrement, il sera demandé au Client de nous communiquer son adresse électronique ainsi que le nom de la personne figurant sur la facture de Devialet Care. 

La Garantie consiste en la réparation d’un Produit qui est fonctionnellement endommagé ou l’échange d’un Produit qui est fonctionnellement endommagé par un Produit équivalent en termes de fonctionnalité et de modèle, le choix entre une réparation ou un échange d’un Produit fonctionnellement endommagé étant entièrement à la discrétion de Devialet. La réparation et/ou l’échange d’un Produit qui est fonctionnellement endommagé est sans frais supplémentaire pour le Client. Néanmoins, la réparation ou l’échange d’un Produit n’est pas disponible dans le cas des exceptions énoncées à l’Article 3 des présentes Conditions Générales. 


La Garantie n’est disponible que sur les territoires sur lesquels Devialet réalise des ventes via le Site Internet. La liste des pays éligibles peut faire l’objet de modification par Devialet. Les prix de la Garantie indiqués sur le Site Internet de Devialet sont indiqués dans la devise du pays de résidence du Client, toutes taxes comprises. 

La Garantie doit être achetée dans la devise du pays de résidence du Client (sauf pour les Emirats arabes Unis, le Qatar, Bahreïn et Oman où les paiements sont faits en USD) par l’un des moyens de paiement autorisés proposés sur le Site Internet. 

Un Produit réparé/échangé disposera de la même garantie que le Produit précédent pour la durée restante de la validité de la Garantie. Les Produits échangés appartiendront à Devialet à compter du jour de l’envoi du Produit échangé. 

La Garantie ne peut être achetée ni appliquée à un Produit reconditionné. La Garantie ne peut pas être achetée ni appliquée à un Produit qui a été modifié ou détérioré par le Client ou un tiers ou pour tout Produit acheté auprès d’un revendeur non autorisé ou pour un Produit considéré comme contrefait. 


  • Modalités de mise en œuvre 

Assistance 


La Garantie permet au Client d’utiliser des services client et des services en ligne. Les réclamations et les questions peuvent être adressées à nos équipes du service client à l’adresse https://help.devialet.com/hc/en-us/requests/new


Echange de Produit 


Un Produit endommagé ne peut être réparé/échangé que pendant la période de validité de la Garantie. Le processus de réclamation inclut le processus de prise de contact par le Client avec Devialet qui diagnostiquera les dommages indiqués par le Client. La décision d’accorder une réparation/un échange est prise à la seule discrétion de Devialet. Dans le cas où Devialet approuverait une réparation/échange, elle organisera le retour du Produit à Devialet. 

A réception du Produit, Devialet identifiera la cause du dommage et, selon sa décision, procèdera à la réparation/l’échange du Produit sous réserve que le dommage indiqué n’entre pas dans l’une des exceptions prévues par l’article 3. Devialet se réserve le droit d’échanger un Produit par un produit reconditionné. 


  • Exclusion de la Garantie 


La Garantie ne couvre pas : 


- les dommages causés au Produit suite à un acte volontaire (intentionnel) ou un acte involontaire (accidentel) du Client ou d’un tiers qui a endommagé le Produit et/ou ses composants ; 


- les dommages liés à l’esthétique du Produit, tel que l’état de propreté du Produit, les éraflures et les coups ; et


- le vol ou la perte du Produit. 


  • Informations au Client 


Pour qu’une réclamation soit prise en compte conformément à la Garantie, le Client doit communiquer les informations suivantes à Devialet : 

  • le numéro d’adhésion de la Garantie ; 
  • le numéro de série du Produit ; 
  • la preuve d’achat de la Garantie ; 
  • la preuve d’achat du Produit indiqué comme endommagé ; et 
  • les dommages constatés sur le Produit et la cause des dommages. 


Si le problème n’est pas résolu, Devialet procèdera à la réparation/l’échange du Produit endommagé sur réception de ce Produit, sous réserve que la réclamation ne concerne pas l’une des exceptions susmentionnées à l’Article 3. 


  • Transfert de la Garantie 


La Garantie et ses droits associés ne peuvent être transférés qu’une seule fois. Un transfert des droits attachés à la Garantie est irrévocable et permanent. Un transfert de la Garantie et de ses droits attachés sont soumis au respect de ce qui suit : 


(i)  le Client doit fournir l’intégralité de la documentation liée à la Garantie (preuve de l’achat initial et le numéro d’adhésion) ;

 

(ii) le Client doit informer Devialet du transfert souhaité par l’envoi d’un email à l’adresse customercare@devialet.com


La notification du transfert inclura le numéro de l’adhésion, le numéro de série du Produit, la preuve de l’achat initial de la Garantie transférée, le nom complet de la personne qui recevra le transfert ainsi que l’adresse, le numéro de téléphone et l’adresse électronique de la personne recevant la Garantie transférée. 


(iii) Le destinataire de la Garantie doit accepter les Conditions générales de la Garantie avant que n’ait lieu le transfert. En cas de validité du transfert, la Garantie transférée couvrira le Produit pour le restant de la validité de la Garantie. 


  • Annulation de la Garantie 


L’achat d’une Garantie peut être annulée dans les 14 jours suivant la date de livraison de la Garantie. Une preuve d’achat valable doit être fournie à cette fin. 

La Période d’essai gratuit de 14 jours s’applique à une Garantie qui a été achetée en même temps que le Produit. 


  • Résiliation 


Devialet se réserve le droit de résilier la Garantie si la réparation/l’échange du Produit est considéré impossible, par ex. si Devialet ne fabrique plus le Produit. Devialet enverra dans ce cas une notification écrite au Client dans les trente (30) jours suivant la réception d’une réclamation et procèdera au remboursement intégral de la Garantie. 


  • Limitation de responsabilité 


Devialet ne sera pas tenue responsable de tout(e) perte ou dommage causé(e) au Client ou à des tiers en raison de la mauvaise utilisation du Produit. 


Les droits du Client en vertu de la loi applicable ne sont pas annulés et remplacés par toute limite des présentes Conditions générales. 


Le plafond de responsabilité de Devialet n’excèdera pas le prix d’achat réel du Produit. Conformément au paragraphe précédent, Devialet ne sera responsable des dommages indirects supportés par le Client 


Devialet ne sera en aucun cas responsable des dommages dépassant son contrôle, comme les services rendus à des tiers de l’exécution d’un ordre (comme le transporteur ou la société chargée des paiements en ligne). 


  • Garantie légale 


Les droits afférents à la Garantie n’affectent aucun droit du Client en vertu du droit local applicable et ne limiteront pas les droits du consommateur en vertu du droit local applicable. 


  • Stipulations générales 


Obligations de Devialet 


Devialet se réserve le droit de sous-traiter les services liés à la Garantie à des tiers sans préjudice des obligations de Devialet en vertu de la Garantie ; Devialet ne sera pas tenue ou responsable à l’égard du Client et ne sera pas réputée avoir manqué ou porté atteinte aux présentes Conditions générales, au titre de tout manquement ou retard dans son exécution en vertu des présentes Conditions générales quand et dans la mesure où ce manquement ou retard est causé par les actions ou circonstances dépassant le contrôle raisonnable de Devialet ou découle de celles-ci, y compris les cas de force majeure, la guerre, l’invasion, l’insurrection, les émeutes, la décision de toute autorité civile ou militaire, l’inondation, l’incendie, les catastrophes naturelles, l’explosion, les actions gouvernementales, les menaces ou actes terroristes, l’urgence nationale, la révolution, l’épidémie, les blocages, les grèves, ou tout autre litige lié au droit du travail (afférent ou non à notre main d’œuvre) ou les restrictions ou retards affectant les transporteurs ou l’incapacité à obtenir, ou le retard dans l’obtention, des fournitures de matériel adéquat ou approprié, la panne des télécommunications ou des matériels ou la panne d’alimentation. L’acceptation de la livraison d’un Produit réparé/échangé par le Client sera considérée comme une renonciation à toutes les plaintes à l’encontre de Devialet au titre de la perte ou des dommages en raison de tout retard. 


  • Données personnelles


(i)  Aux fins de l’amélioration de la qualité de nos services, Devialet se réserve le droit d’enregistrer tout ou partie des conversations ayant lieu entre le Client et Devialet.


(ii) Le Client reconnaît et accepte que Devialet puisse recueillir et traiter des données au titre de l’exécution des services rendus en vertu de la Garantie.


(iii) Le Client reconnaît et accepte que Devialet puisse transférer des données recueillies à des prestataires de service ou à l’une de ses sociétés affiliées au titre de l’exécution des services rendus en vertu de la Garantie. 


(iv) Les données recueillies seront traitées conformément à la politique de confidentialité de Devialet, disponible à l’adresse https://www.devialet.com/fr-fr/legal/privacy-policy/

Terms and conditions of Devialet Care Guarantee (Devialet Dione and Devialet Mania)

The Devialet Care guarantee (the “Guarantee”) is subject to the following terms and conditions (the “Terms and Conditions”), which govern the relation between you (the “Customer”) and Devialet (“Devialet” or “us” or “we”). Subject to these present Terms and Conditions, the Guarantee covers:

i. Guarantee for Devialet Dione
ii. Guarantee for Devialet Mania

Hereinafter collectively (the “Product”). The Guarantee only covers the Product to which it is registered for. Therefore, in case of several Products purchased, the purchase of a separate Guarantee will be required for each purchased Product. The Guarantee will allow the Customer to benefit from customer service support and access to an online service for the Product. The use of the Guarantee is subject to the registration of the unique membership number indicated on the Guarantee. The registration is a mandatory requirement for a Customer to be able to use the Guarantee. Such registration must be made within thirty (30) days from the date of delivery of the Product. A Guarantee cannot be purchased nor be applied to a Product that has a delivery date of +30 days. The term of the Guarantee is for sixty (60) months commencing on the date of delivery of the Product. The price of the Guarantee appears on the original invoice of the Guarantee.

1. Scope of the Guarantee

General scope

The Guarantee will be activated upon the registration of the unique number of the Guarantee membership. As part of the registration process, the Customer will be asked to provide us with the Customer’s email address as well as the name of the person appearing on the Devialet Care invoice. The Guarantee includes the repair of a functionally damaged Product or the exchange of a functionally damaged Product with an equivalent Product in terms of functionality and model, the choice between a repair or an exchange of a functionally damaged Product is entirely at the discretion of Devialet. The repair or the exchange of a functionally damaged Product is at no additional cost for the Customer. The Guarantee is only available in the territories to which Devialet sells to through the Website. The list of eligible countries is subject to modification by Devialet. The price of the Guarantee appearing on Devialet’s Website is indicated in the currency of the country of residence of the Customer, all sales taxes included. The purchase of the Guarantee must be paid in the currency of the country of residence of the Customer (except for the UAE where payments are made in USD) by one of the authorized means of payment offered on the Website. A repaired/exchanged Product will enjoy the same warranty as the previous Product for the rest of the validity of the Guarantee. Exchanged Products will become the property of Devialet from the day of dispatch of the exchanged Product. The Guarantee cannot be purchased for nor applied to a Product that has been tampered or altered by the Customer or a third party or for any Product purchased from a non-authorized reseller or for a product that is deemed a counterfeit. In regard to the replacement of battery for a Devialet Mania product, Devialet adheres to changing the battery once during the term of the Guarantee. Any change of a battery for Devialet Mania can only be made by Devialet and upon the direct request of the Customer.

2. Modalities of implementation

Assistance

The Guarantee provides Customers with customer service support and online services. Claims and questions can be addressed to our customer service teams available at https://help.devialet.com/hc/requests/new

Exchange of Product

A damaged Product can only be repaired/exchanged during the term of the Guarantee. The process for a claim includes the process of the Customer contacting Devialet who will diagnose the damage claimed by the Customer. The decision of granting a repair/exchange is at the sole discretion of Devialet. In the event where Devialet approves a repair/exchange, Devialet will arrange for the return of the Product to Devialet. Upon receipt of the Product, Devialet will establish the cause of the damage and based on its decision proceed with the repair/exchange of the Product, subject to a claimed damage not being within one of the exceptions set out in clause 3. Devialet withholds the right to exchange a Product with a refurbished product.

3. Exceptions to the Guarantee

The Guarantee does not cover:
- Damages caused to the Product as a consequence of a voluntary (intentional) or involuntary (accidental) act by the Customer or a third-party that damages the Product and/or its components;
- Damages related to the appearance and the esthetics of the Product, such as the state of cleanliness of the Product, scratches, bumps; and
- Theft or loss of the Product.

4. Customer information

For a claim to be taken into consideration under the Guarantee, the Customer is requested to provide the following information to Devialet:
− The Guarantee membership number;
− The serial number of the Product;
− The proof of purchase of the purchased Guarantee;
− The proof of purchase of the claimed damaged Product; and
− The damages found on the Product and the cause of the damages.

If the upon receipt of the latter, subject to the claim not being under any of the foregoing exceptions in clause 3. problem remains unsolved, Devialet will proceed with the repair/exchange of the damaged Product

5. Transfer of the Guarantee

The Guarantee and its attached rights are limited to one transfer. A transfer of the rights attached to the Guarantee are irrevocable and permanent. A transfer of the Guarantee and its attached rights are subject to compliance with the following:

(i) the Customer must provide full documentation of the Guarantee (proof of original purchase and the Guarantee membership number);

(ii) the Customer must inform Devialet of the intended transfer by sending an email to customercare@devialet.com Notice of the transfer shall include the membership number, serial number of the Product, proof of original purchase of the Guarantee transferred, full name of the person who will receive the transfer as well as the address, telephone number and email address of the person receiving the transferred Guarantee.

(iii) The receiver of the Guarantee must agree to the Terms & Conditions of the Guarantee prior to the transfer taking place. In the event of a valid transfer, the transferred Guarantee will cover the Product for the remainder of the validity of the Guarantee.

6. Withdrawal of the Guarantee

The purchase of a Guarantee can be withdrawn within 14 days from the date of delivery of the Guarantee. A valid proof of purchase must be provided for a withdrawal. The 14-day Day Trial Period applies to a Guarantee that has been bought at the same purchase occasion as the Product. A valid proof of purchase must be provided, such proof of purchase must prove that the purchase date of the Guarantee is the same as the Product.

7. Termination

Devialet reserves the right to terminate the Guarantee if the repair/exchange of the Product is deemed to be impossible, e.g. in such event where Devialet no longer manufactures the Product. Devialet will in such event provide the Customer with a written notice within thirty (30) days from the receipt of a claim and will proceed with a full reimbursement of the Guarantee.

8. Limitation of Liability

Devialet shall not be held liable for any loss or damage caused to the Customer or third parties due to the misuse of the Product. The Customer’s statutory rights based on applicable law are not superseded by any limit contained in these Terms and Conditions. The maximum liability of Devialet shall not exceed the actual purchase price of the Product. In compliance with the previous paragraph, Devialet shall not be liable for any indirect damages suffered by the Customer. Devialet shall not, in any case, be liable for damages arising out of its control, such as services which are rendered by third-parties for the execution of an order (such as the carrier or the company in charge of online payments).

9. Legal Guarantee

The rights under the Guarantee do not affect any rights of the Customer under applicable local law and shall not limit consumers rights under applicable local law.

10. General provisions

Obligations of Devialet

Devialet reserves the right to subcontract or outsource the services under the Guarantee to third parties without prejudice to Devialet’s obligations under the Guarantee; Devialet shall not be responsible or liable to Customer, nor shall Devialet be deemed to have defaulted on or breached these Terms and Conditions, for any failure or delay in its performance under these Terms and Conditions when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the reasonable control of Devialet, including, but without limitation, acts of God, war, invasion, insurrection, riot, order of any civil or military authority, flood, fire, natural disasters, explosion, governmental actions, terrorist threats or acts, national emergency, revolution, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage. The acceptance of the delivery of a repaired/exchanged Product by the Customer shall be deemed as a renunciation of all complaints against Devialet for loss or damages due to any delay.

11. Privacy

(i) For the purpose of improving the quality of our services, Devialet reserves the right to register all or only some parts of the conversations between the Customer and Devialet;

(ii) The Customer recognizes and accepts that Devialet may collect and process data for the execution of the services rendered under the Guarantee;

(iii) The Customer recognizes and accepts that Devialet may transfer data collected to service providers or to one of its affiliated companies for the execution of the services rendered under the Guarantee.

(iv) Data collected will be processed under the privacy policy of Devialet, available at https://www.devialet.com/privacy-policy/

Terms and conditions of Devialet Care Phantom and Devialet Gemini I (until April 2023)

The Devialet Care guarantee (the ​“Guarantee​”) is subject to the following terms and conditions (the “​Terms and Conditions​”), which govern the relation between you (the “​Customer​”) and Devialet (“​Devialet​” or “​us​” or “​we​”). Subject to these present Terms and Conditions, the Guarantee covers:
i. Guarantee for Phantom I: 108dB Classic, Silver, Black, Gold, Gold Phantom Opéra de Paris | Devialet
ii. Guarantee for Phantom I: 103dB Classic, Silver, Black, Gold, Gold Phantom Opéra de Paris | Devialet
iii. Guarantee for Phantom II: 98dB White, Black, Gold Phantom Opéra de Paris | Devialet
iv. Guarantee for Phantom II: 95dB White, Black, Gold Phantom Opéra de Paris | Devialet
v. Guarantee for Devialet Gemini I

Hereinafter collectively (the “Product”). As such, it is stated that the Product will require separate Guarantees. The Guarantee only covers the Product to which it is registered for. Therefore, in case of several Products purchased, the purchase of a separate Guarantee will be required for each purchased Product. The Guarantee will allow the Customer to benefit from customer service support and access to an online service for the Product. The use of the Guarantee is subject to the registration of the unique membership number indicated on the Guarantee card included in the packaging that came with the Guarantee. The registration is a mandatory requirement for a Customer to be able to use the Guarantee. Such registration must be made within thirty (30) days from the date of delivery of the Product. A Guarantee cannot be purchased nor be applied to a Product that has a delivery date of +30 days. The term of the Guarantee is for a period of thirty-six (36) months commencing on the date of delivery of the Product, with the exception of Guarantees holding a serial number starting with P4WL or with PR3M, in which the Guarantee is for a term of sixty (60) months commencing on the date of delivery of the Product. The price of the Guarantee appears on the original invoice of the Guarantee.

For further information, please refer to the pricing list available on Devialet’s Website (the “​Website​”). The Guarantee is only available in the territories to which Devialet sells to through the Website. The list of eligible countries is subject to modification by Devialet. The prices of the Guarantee appearing on Devialet’s Website and the Exchange Fee are indicated in the currency of the country of residence of the Customer, all sales taxes included. The purchase of the Guarantee must be paid in the currency of the country of residence of the Customer (except for the UAE where payments are made in USD) by one of the authorized means of payment offered on the Website. A repaired/exchanged Product will enjoy the same warranty as the previous Product for the rest of the validity of the Guarantee. Exchanged Products will become the property of Devialet from the day of dispatch of the exchanged Product. The Guarantee cannot be purchased for nor applied to a Product that is refurbished. The Guarantee cannot be purchased for nor applied to a Product that has been tampered or altered by the Customer or a third party or for any Product purchased from a non-authorized reseller or for a product that is deemed a counterfeit. In regard to the replacement of battery for a Devialet Gemini I product, Devialet adheres to changing the battery in such event where the battery has been diagnosed by Devialet as being defect. Any change of a battery for Devialet Gemini I can only be made in a store operated by Devialet. (iii) The receiver of the Guarantee must agree to the Terms & Conditions of the Guarantee prior to the transfer taking place. In the event of a valid transfer, the transferred Guarantee will cover the Product for the remainder of the validity of the Guarantee.

The purchase of a Guarantee can be withdrawn within 14 days from the date of delivery of the Guarantee. A valid proof of purchase must be provided for a withdrawal. The 14-day Day Trial Period applies to a Guarantee that has been bought at the same purchase occasion as the Product. A valid proof of purchase must be provided, such proof of purchase must prove that the purchase date of the Guarantee is the same as the Product.

7. Termination

Devialet reserves the right to terminate the Guarantee if the repair/exchange of the Product is deemed to be impossible, e.g. in such event where Devialet no longer manufactures the Product. Devialet will in such event provide the Customer with a written notice within thirty (30) days from the receipt of a claim and will proceed with a full reimbursement of the Guarantee.

8. Limitation of Liability

Devialet shall not be held liable for any loss or damage caused to the Customer or third parties due to the misuse of the Product. The Customer’s statutory rights based on applicable law are not superseded by any limit contained in these Terms and Conditions. The maximum liability of Devialet shall not exceed the actual purchase price of the Product. In compliance with the previous paragraph, Devialet shall not be liable for any indirect damages suffered by the Customer. Devialet shall not, in any case, be liable for damages arising out of its control, such as services which are rendered by third-parties for the execution of an order (such as the carrier or the company in charge of online payments).

9. Legal Guarantee

The rights under the Guarantee do not affect any rights of the Customer under applicable local law and shall not limit consumers rights under applicable local law.

10. General provisions

Obligations of Devialet

Devialet reserves the right to subcontract or outsource the services under the Guarantee to third parties without prejudice to Devialet’s obligations under the Guarantee; Devialet shall not be responsible or liable to Customer, nor shall Devialet be deemed to have defaulted on or breached these Terms and Conditions, for any failure or delay in its performance under these Terms and Conditions when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the reasonable control of Devialet, including, but without limitation, acts of God, war, invasion, insurrection, riot, order of any civil or military authority, flood, fire, natural disasters, explosion, governmental actions, terrorist threats or acts, national emergency, revolution, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage. The acceptance of the delivery of a repaired/exchanged Product by the Customer shall be deemed as a renunciation of all complaints against Devialet for loss or damages due to any delay.

Privacy

(i) For the purpose of improving the quality of our services, Devialet reserves the right to register all or only some parts of conversations between the Customer and Devialet;

(ii) The Customer recognizes and accepts that Devialet may collect and process data for the execution of the services rendered under the Guarantee;

(iii) The Customer recognizes and accepts that Devialet may transfer data collected to service providers or to one of its affiliated companies for the execution of the services rendered under the Guarantee.
